As
from the date of the original installation Kooline Distributing Pty Ltd
(‘Kooline’) warrants each Kooline manufactured Product (‘the equipment’)
to be free from defects in material and workmanship under normal use and
service, for a period of one (1) year parts only on Kooline Cabinet Body
Structure plus an additional one (1) year parts only on compressor. Labour to replace faulty parts on Kooline Cabinet Body
Structure will be one (1) year.
Labour to replace faulty parts on Kooline Cabinet Compressor
will be three (3) months in Townsville area only.
Other brand name equipment sold by Kooline will rely on the
manufacturer’s warranty of that brand equipment.
No Warranty on any glass, in any Kooline or other product, during
transport to site or after installation on site.
No Warranty on any second hand equipment of any brand name sold by
Kooline. This warranty only
applies and is solely for the benefit of the original purchaser
(‘the
customer’) of the equipment from Kooline.
Kooline’s
obligation under this warranty is limited solely to replacement (without charge)
of any part or parts of the equipment, which are defective, and any labour (with
exemptions as below) required therein. Whether or not any part or parts is
defective is determined at the sole discretion upon examination by the local
Kooline Distributor. Kooline reserves the sole right to nominate the service
repairer for work carried out under this warranty agreement.
Liability
under this warranty does not include: -
1.
Any loss,
damage or expense directly or indirectly arising from the customer’s use or
inability to use the equipment.
2.
Any
equipment which has been subject to misuse (including but not limited to the use
of abrasive chemicals), improper cleaning methods, neglect, alteration,
incorrect installation, flood, fire or other act of God, or to any equipment
which has been altered by any person so as to affect performance or reliability.
3.
Any
special indirect or consequential damages to any person or property including
any economic loss whatsoever resulting from any defective material or
workmanship howsoever arising.
4.
Breakage
of glass or plastic components or the replacement of fluorescent tubes or
starters.
5.
Any costs
other than standard labour costs including any labour costs required outside
normal working hours.
6.
Failure of
any equipment due to any negligence or fault on the part of the customer.
7.
Travelling
time where the equipment is located outside the Townsville area.
Kooline
does not guarantee or imply or agree that any service to be performed under this
warranty will be carried out within any particular time limit. This warranty
does not extend to equipment supplied under corporate accounts as determined at
the sole discretion of Kooline. This warranty is a complete warranty agreement
between Kooline and the customer, and all representations made by either party
or its agent not specifically included herein is expressly excluded from this
warranty. This warranty shall not be varied, supplemented, qualified or
interpreted by any prior course of dealing between the parties or by usage of
the trade. Sales are made on the express understanding that there are no express
or implied warranties other than the express warranty contained herein, and that
there are no implied warranties that the equipment is merchantable or fit for a
particular purpose (except as imposed by law) other than the expressed warranty
as listed above and set forth herein. This warranty is not to be taken to either
express or imply a release or indemnity to the customer for costs of :-
1. Normal operational maintenance, adjustments and cleaning. 2. Repairs
caused by equipment modification without Kooline’s written approval.
3. Premium labour rates, holidays or overtime attached to the warranty
herein. Replacement of parts or
labour under this warranty may attract a goods and services tax, and any such
tax imposed in respect thereof is the responsibility of the customer.

14 days of a claim arising. Kooline
accepts no liability hereunder where notification is received outside of the
14-day period. When the claim
details have been received and confirmed by Kooline, a warranty service
authority will be issued and an authorised Kooline repairer will be contracted
to carry out the repairs. Kooline accepts no liability for any repairer’s fees
or repair work carried out without authorisation by Kooline prior to
commencement of the service or repair.
